Oregon Restraining Orders
In Oregon, you can request a restraining order against a family member, household member, or someone with whom you have had a sexual relationship who has abused or threatened to abuse you or your children within the last 180 days. Abusers have:
- Physically hurt you or attempted to physically hurt you
- Made you afraid that he or she would soon physically hurt you
- Made you have sexual relations against your wishes by using force or threats of force
- Made it clear you continue to be in danger of further abuse
In order to file a restraining order, you’ll need to identify yourself and the abuser, give police an address at which to serve the order, and a contact address for you. If you wish to keep your address confidential, you may use our office location as your contact address and we will intercept any communications from an abuser or their friends.
Stalking Protective Orders
Is someone scaring you by watching, following, or contacting you against your wishes? If so, we can help you file a stalking protection order, which is intended to prevent someone from repeatedly making unwanted contact with you in an effort to intimidate, harass, or frighten you. Oregon determines someone is engaging in unwanted contact if he or she:
- Comes near you or into your sight
- Follows you
- Waits outside your home, workplace, or school
- Communicates with you in any way (mail, email, phone, or through another person)
- Damages your home, workplace, or school
Furthermore, these actions must cause you or a household member fear multiple times. We can help you file for a stalking order and accompany you to the administrative hearing where your stalker will have a chance to tell their side of the story. You may use our address for your contact address on the petition if you wish to keep your personal home address confidential.
You Don’t Have to Face This Alone
It can be difficult to go through the arduous process of filing for and defending a restraining or stalking order. You must recall everything that has happened and face your abuser in court. We understand how stressful this prospect is, which is why many people suffer silently through abuse, hoping it will resolve itself. Though this makes sense, you deserve better. Let us represent you and your right to privacy and peace.
